We’re living in an age of emergency. LAW346 links the past with the present. It first takes us back to the roots of emergency theory. Beginning with its development in history, we start in Weimar Germany and the rise of the Nazis; then look at the use of martial law in response to political violence; before looking at modern Australian crises concerning natural disasters and the Covid-19 pandemic; as well as Brexit in the UK and use of prerogative. The unit blends history with politics and public law, and explore new ways of thinking about how we respond to political emergency within our democracy ruled by liberal legal order.
