#UNELaw’s Aileen Kennedy presents at the the Intersex Human Rights Australia webinar series on Wednesday 30th June. Her webinar interrogates the underlying assumptions made by judges when decision making about sex and gender.

Are judges influenced by theories that gender is determined by our brain architecture? (Based on the idea that men and women have distinctly different brains.) This theory seems to underpin judicial support for medical interventions to change the bodies of trans minors to reflect their gender identity. By contrast, medical decisions approving interventions on intersex children do not rely on brain-based gender theories. Judges use a 70-year-old debunked framework. Aileen explores why this out-of-date theory continues to dominate decisions affecting intersex people.
