Getting Flexible with Copyright

Berenice Scott, UNE Copyright Officer

One of the roles of the Copyright Office in TLC is to provide copyright assistance to staff when they are using and creating copyright resources for educational purposes such as developing new unit materials, updating or creating CD and online units, and putting together resources for face-to-face teaching and videoconferencing.

Until recently, there were some valid uses of educational resources not covered by copyright exceptions and licences that would require copyright owner’s permission.

The Copyright Amendment Act 2006 changed that by introducing an important new exception for educational institutions which allows the free use of copyright materials in narrow circumstances for the purposes of educational instruction.

Known as a flexible dealing provision, Section 200AB sets out a number of rules which must be applied to decide whether a particular use of copyright material will be allowed.  Importantly it must not be used if there is an existing exception or licence that can be applied.

The purpose of this new provision is to enable institutions to use copyright materials for a range of socially beneficial purposes, in a flexible way. It has already been useful to UNE teaching staff, allowing for the first time, uses such as: copying a foreign language film for students when the only copy available under licence was subtitled; making a compilation teaching resource of segments of film adaptations of the same Shakespeare play when a commercial copy of the same resource could not be purchased; converting a VHS tape to DVD where it is not possible to buy a DVD of the same item and the DVD is needed for teaching purposes.

Section 200AB also has applications for library copying and assisting persons with a disability. More information about applying this new flexible dealing provision is available at <http://www.une.edu.au/copyright/section200ab.php> and other copyright information related to copyright for teaching and research is available on the copyright web pages.

As this is a new provision, you are encouraged to contact the Copyright Office <http://www.une.edu.au/copyright/copyright-office.php> in the first instance, as it may be that your required use is already covered in other ways.
